Terms and Conditions

Hosting and Maintenance

Contract

Hosting and Maintenance plan customers are not held to any formal contract term. A hosting or maintenance customer can cancel at any time.

Billing

Hosting and Maintenance plan customers are billed monthly for their active plan. Customers will typically be billed on the same date every month, however adjusted billing dates may occur due to calendar, account changes, or resource usage per month.

Website Access

Website access to manage the backend, content, media, and basic functionality is granted to all customers.

Higher level backend and server-level privileges are not granted to customers for administration, security, and performance reasons.

Ownership and Termination

A customer may lose access to the Hoot Host platform and their website if their subscription is cancelled, or if the subscription is terminated for any reason.

Websites hosted or maintained by Hoot Host are completely owned by the business or customer.

Cancellation

A customer may cancel their hosting or maintenance subscription at any time.

If a customer cancels their subscription they will be supplied all core files, databases, code, content, media, and materials owned by their company so they can migrate the website to another provider.

Upon account cancellation Hoot Host reserves the right to remove HootPress (our enhanced version of WordPress) and all premium theme, plugin, or tool licenses used to build and maintain the website. See Third Party Licensing section for licensing rights and information.

Fees

Cancellation fees are only applicable if there are any passed due fees on a customer account.

A customer will not be granted full privileges to their website or the core files of the website until the determined fees are paid in full.

Once the determined fees are paid in full, migration service off the Hoot Host platform will be provided free of charge.

Plan Changes and Downgrades

Existing customers on the Business and Enterprise plans may downgrade to a lower level plan at any time.

Enterprise Maintenance and Management Plan Limitations

Hoot Host Enterprise Maintenance and Management plans include “Unlimited Tasks Every Month”. Which refers to all requested website tasks and updates in a monthly period. Providing prioritized status for Enterprise Maintenance and Management plan subscribers. However, Hoot Host reserves the right to limit Enterprise Maintenance and Management plans to 10 hours per month.

Monthly Hours Per Plan
Each Hoot Host website maintenance and/or website builder plan includes set monthly hours for ongoing services. Monthly hours vary by plan.

Monthly hours are managed by the individual Hoot Expert assigned to each customer account. Monthly reports are only provided to website customer by request.

Monthly strategy meetings are only provided to website customer by request. Strategy meeting time investment is deducted from customer plan monthly hours total.

Third Party Licensing

Hoot Host may license third party themes, plugins, or tools for our Website Builder, Website Maintenance, or Website Hosting customers.

While Hoot Host may configure and use third party themes, plugins, and tools in our customer’s website. Hoot Host does not hold responsibility for maintaining the active third party license, or purchasing license renewals. Customers and website owners are responsible for the theme, plugin, or tool licenses used in their website.

Definitions

“HootPress” refers to our customized version of WordPress including a modernized interface with custom organization of WordPress features and premium plugins / tools integrated. Premium plugins and tools vary by website.

“Google Cloud + LiteSpeed” refers to a LiteSpeed Performance Web Server configured via Google Cloud. VM instance and technical resources vary.

In WordPress specific products “LiteSpeed” may refer to OpenLiteSpeed-WordPress.

“Google Cloud C2 and LiteSpeed upgrades available.” refers to standard hosting plans being managed by Flywheel or Google Cloud General Purpose that can be upgraded to compute-optimized hosting plans.

“Google Cloud C2” refers to compute-optimized hosting. VM instance and technical resources vary.

“Scalable Series / Machine Type” and “Scalable Technical Resources” refers to standard hosting plans being managed by Flywheel or Google Cloud General Purpose that can be upgraded to more sufficient Series / Machine Type / VM instance without incurring upgrade fees.

“Google SEO Essentials” refers to technical configurations to ensure the website is able to be crawled and indexed by Google. Including verification of site ownership and sitemaps with Google, installation of Google Analytics, and related standard configurations for search engine optimization.

“Ongoing Search Engine Optimization” refers to premium and ongoing search engine optimization efforts to improve the website’s on-page SEO standards, content optimization, keyword analysis, Google Generative AI optimization, and related technical SEO configurations.

One Tree Planted Business Partnership

Hoot Host is a registered One Tree Planted Reforestation Business Partner. Hoot Host is committed to donating $10 USD to plant 10 trees with One Tree Planted, a 501(c)3 non-profit organization, per specified online sale. This donation program only applies to the initial sign up sale of: Professional Maintenance Plan, Enterprise Maintenance Plan, Professional Website Builder, Premium Website Builder. From each of these plans initial sign up rate, $10 USD will be donated to One Tree Planted to plant 10 trees.

Website Builder

Contract

Website Builder customers are not held to any formal contract term. A Website Builder customer can cancel at any time.

Website Builder plan customers are billed monthly for their active plan. Customers will typically be billed on the same date every month, however adjusted billing dates may occur due to calendar, account changes, or resource usage per month.

Website Access

Website access to manage the backend, content, media, and basic functionality is granted to all customers.

Hoot Host websites are developed so they cannot be transferred to another platform or hosting provider without approval.

Cancellation

A customer may cancel their Website Builder subscription at any time.

If a customer cancels their Website Builder subscription they will be supplied all content, media, and basic materials owned by their company so they can build a new website with another provider.

If a customer wishes to keep the website that was built and hosted by Hoot Host, migration and transfer fees will only apply in the first year (12 renewal billing cycles) of service. After the first year a customer may transfer the website in its entirety to another platform for free.

Migration and Transfer Fees

Migration and transfer fees, if applicable, are determined by date of sign-up, amount of monthly renewals processed, and any passed due fees on a customer account.

A customer will not be granted full privileges to their website or the core files of the website until the determined fees are paid in full.

Once the determined migration and transfer fees are paid in full, migration service off the Hoot Host platform will be provided free of charge.

Content Blocks

Under the backend navigation on the left you will see CONTENT BLOCKS. In here is where you see options to edit each page’s unique slideshow, header, or footer. All page’s custom content blocks are labeled accordingly and are edited using the page builder just like any page or post of the site.

For background images: Click on the pencil icon on the left side of the row. In the popup window click STYLE and you will see the option to edit or change the background image of a row or header.
